The Ministry of Home Affairs issues procedures for inspecting the quality of high-risk imported goods.

TCTM - On August 11, 2026, the Ministry of Home Affairs issued Decision No. 946/QD-BNV announcing newly issued administrative procedures and those that were abolished related to product and goods quality; standards, technical regulations, and conformity assessment in the field of occupational safety and hygiene under the state management scope of the Ministry of Home Affairs.

Notably, under Decision No. 946/QD-BNV, the Ministry of Home Affairs has issued procedures for quality inspection of imported goods with high risk levels under the state management responsibility of the Ministry of Home Affairs, as listed in the Appendix issued together with Circular No. 16/2026/TT-BNV.

Enterprises importing elevators, escalators, and passenger conveyors, as well as safety components of elevators, which are included in the list of high-risk goods under Circular No. 16/2026/TT-BNV, should immediately review their procedures and documentation to avoid delays in customs clearance.

Accordingly, the procedures for quality inspection of imported goods with high risk levels under the state management responsibility of the Ministry of Home Affairs will be carried out by the provincial People's Committee or an authorized agency delegated by the provincial People's Committee.

The procedures will be conducted online via the National Single Window Portal or the National Public Service Portal.

In case these systems encounter issues or in force majeure situations prevent electronic information exchange, processing shall be carried out in accordance with Article 17 of Decree No. 85/2019/ND-CP on the national single window mechanism, ASEAN single window, and specialized inspection of exported and imported goods.

The documentation and procedures are divided into two cases: (1) Imported goods with a Certificate of Conformity; (2) Imported goods without a Certificate of Conformity.

For goods without a Certificate of Conformity, after registering for inspection, the enterprise completes customs procedures to bring the goods to a storage location, and simultaneously contacts the designated certification body to conduct conformity assessment with national technical regulations.

The processing time is 01 working day from the date the dossier is complete and valid. Specifics for each case are as follows.

Incomplete dossiers must be supplemented and completed within 07 working days from the date of receipt. If the dossier is complete but fails to meet labeling requirements, the remedy period shall not exceed 05 working days.

Case of imported goods with a Certificate of Conformity

Regarding the dossier components for imported goods with a Certificate of Conformity: 

(1) Registration for state inspection of imported goods quality according to Form No. 1 of Appendix VII issued together with Decree No. 37/2026/ND-CP;

(2) Certificate of Conformity issued by a designated conformity assessment body, containing information relevant to the imported goods. In case the Certificate of Conformity is issued for a shipment, it must include information relevant to the imported shipment (product name; brand, model; technical specifications; origin, manufacturer; volume/quantity; import customs declaration; invoice);

(3) Photos or descriptions of goods characteristics along with the contents of the main label (for goods requiring labeling);

(4) A sample supplementary label (if the main label does not contain sufficient content as required) for goods requiring labeling;

In case of using electronic labels, labeling must comply with the provisions of law on goods labeling. Importing organizations and individuals are responsible for the validity of import dossiers.

Regarding the order and procedures for quality inspection of imported goods with a Certificate of Conformity:

Step 1. Importing organizations and individuals register for state inspection of imported goods quality as prescribed at the local product and goods quality inspection authority (hereinafter referred to as the inspection authority).

Step 2. The inspection authority receives the registration dossier for quality inspection of imported goods according to Form No. 2 of Appendix VII issued together with Decree No. 37/2026/ND-CP.

In case the dossier is incomplete, the inspection authority confirms the missing contents, simultaneously confirms that the importing organization or individual has registered for quality inspection of imported goods on the inspection registration form, and requires the importing organization or individual to supplement and complete the dossier within 07 working days from the date of receipt of the dossier.

If the dossier has not been fully supplemented after the above deadline, the importing organization or individual must send a written document to the inspection authority stating the reasons and the expected time for completing the dossier supplementation.

Step 3. After the importing organization or individual has fully completed the dossier:

- Case of complete and compliant dossier: Within 01 working day from the date the dossier is complete and valid, the inspection authority issues a Notice of state inspection results on imported goods quality meeting quality requirements according to Form No. 3 of Appendix VII issued together with Decree No. 37/2026/ND-CP, and sends it to the importing organization or individual to carry out customs clearance procedures;

- Case of complete dossier but failure to meet labeling requirements: The inspection authority requires the importing organization or individual to remedy within a period not exceeding 05 working days. The inspection authority only issues a Notice that the shipment meets quality requirements when there is evidence proving the labeling remedy as prescribed. In case the remedy cannot be made, the inspection authority issues a Notice of state inspection results on imported goods quality not meeting labeling requirements according to Form No. 3 of Appendix VII issued together with Decree No. 37/2026/ND-CP;

- Case of complete dossier but the Certificate of Conformity is not consistent with the corresponding technical regulations or not consistent with the import shipment's dossier: The inspection authority issues a Notice of state inspection results on imported goods quality not meeting quality requirements, specifying the non-compliant contents, and sends it to the importing organization or individual and the customs authority for handling within their authority;

- Case where the importing organization or individual fails to fully complete the dossier within the prescribed time limit: Within 01 working day from the expiration of the dossier supplementation period, the inspection authority issues a Notice of state inspection results on imported goods quality according to Form No. 3 of Appendix VII of Decree No. 37/2026/ND-CP, clearly stating: "The shipment has not fully completed the dossier," and sends it to the importing organization or individual and the customs authority;

- Case of detecting signs of risk, fraud, or inconsistent information between the dossier and management data, the inspection authority issues a Notice of quality inspection results of imported goods not meeting requirements according to Form No. 3 of Appendix VII issued together with Decree No. 37/2026/ND-CP.

Case of imported goods without a Certificate of Conformity

Regarding the dossier components for imported goods without a Certificate of Conformity:

(1) Registration for state inspection of imported goods quality according to Form No. 1 of Appendix VII issued together with Decree No. 37/2026/ND-CP;

Step 4. Organizations and individuals contact the designated certification body to conduct conformity assessment with the corresponding national technical regulations.

Step 5. After the importing organization or individual has fully completed the dossier, the procedures shall follow the regulations as in step 3 of the case of imported goods with a Certificate of Conformity.
