The Ministry of Home Affairs issues the List of Risky Goods: Elevators and escalators belong to the high-risk group.

EM - On July 28, 2026, the Ministry of Home Affairs issued Circular No. 16/2026/TT-BNV stipulating the List of products and goods with medium risk level and high risk level under the state management responsibility of the Ministry of Home Affairs.

Issued together with Circular 16/2026/TT-BNV is the List of products and goods with medium risk and high risk levels under the state management responsibility of the Ministry of Home Affairs, along with their HS codes.

The List of products and goods with a high risk level and the corresponding quality management requirements for such high-risk products and goods are stipulated in Section I of the List of products and goods with medium and high risk levels issued together with Circular 16/2026/TT-BNV.

The List of products and goods with a medium risk level and the corresponding quality management requirements for such medium-risk products and goods are stipulated in Section II of the List of products and goods with medium and high risk levels issued together with Circular 16/2026/TT-BNV.

Specifically, the List of products and goods with medium and high risk levels under the state management responsibility of the Ministry of Home Affairs is as follows:

According to the list issued with the Circular, elevators and elevator safety components are classified as products and goods with a high risk level.

The safety components included in the list are:

* Landing door locking devices and car door locking devices;

* Safety gears;

* Drive machines (braking system of the drive machine);

* Overspeed governors;

* Buffers;

* Shut-off valves and check valves for hydraulic lifts.

This product group has HS codes 8428.10, 8431.31.10, and 8431.31.20; and is subject to QCVN 02:2019/BLĐTBXH on occupational safety for lifts and QCVN 32:2018/BLĐTBXH on occupational safety for home lifts.

Regarding management requirements, the products must be declared conforming based on the results of conformity certification by a designated certification organization as per legal regulations. Conformity assessment applies Mode 5, Mode 7, or Mode 8 according to Circular 14/2026/TT-BKHCN.

Imported goods belonging to this group must undergo state quality inspection as prescribed.

The Circular also classifies escalators and passenger conveyors as products and goods with a high risk level, with HS codes 8428.40.00, 8431.31.10, and 8431.31.20.

This group of goods is subject to QCVN 11:2012/BLĐTBXH on occupational safety for escalators and passenger conveyors.

Similar to lifts, escalators and passenger conveyors must be declared conforming based on certification results from a designated organization; apply the corresponding conformity assessment mode and undergo state quality inspection upon import.

Specifically, the assessment and certification according to QCVN 11:2012/BLĐTBXH shall be carried out for the content specified in section 3.1 of the regulation.

Thus, the issuance of Circular 16/2026/TT-BNV provides a basis for determining which products and goods are subject to medium or high risk, thereby applying corresponding quality management measures under Decree 37/2026/NĐ-CP.

Article 6. Transitional Provisions

1. Conformity certificates and Notifications of receipt of conformity declarations that have been issued for products and goods within the scope of this Circular before the effective date of this Circular shall remain valid until the expiry date stated in the Conformity certificate or Notification of receipt of the conformity declaration.

2. Any applications for conformity certification that were received before July 1, 2026, but have not yet been processed, shall continue to be handled according to the regulations in effect at the time of application receipt.

3. Conformity assessment organizations that have been designated to carry out conformity assessment for Group 2 products and goods under the management responsibility of the Ministry of Home Affairs, and whose designation decision remains valid, may continue to perform conformity assessment under the provisions of this Circular until the expiry date of the designation decision.

4. During the period the National Single Window portal is being adjusted and upgraded to be consistent with the List of products and goods with medium and high risk levels issued with this Circular, organizations and individuals importing products and goods on the List shall register for state quality inspection of imported goods on the National Public Service Portal or follow the instructions of the inspection agency. The receipt, processing of dossiers, and return of results for state quality inspection of imported goods shall be carried out in accordance with the Government's Decree 37/2026/NĐ-CP dated January 23, 2026, and relevant legal regulations; ensuring no disruption to the lawful import activities of organizations and individuals.
