EM – After Elevator Magazine published 2 articles: “Another person was killed in an elevator accident”, “Elevator landing doors and user safety”, many readers sent letters to the editorial office, asking whether the state management agency conducts an independent investigation and specific assessment of this incident? To widen public opinion, Elevator Magazine had a quick discussion with representatives of the Department of Occupational Safety, Ministry of Labor, Invalids and Social Affairs on this issue.
At the meeting, Mr. Nguyen Van Yen, Head of Legal – Inspection Department, Department of Occupational Safety and Health, Ministry of Labor, Invalids and Social Affairs said, right after the elevator accident at Children’s Hospital. On July 16, in Can Tho, with responsibility for state management, the Department of Inspection and Legal Affairs discussed with the Department of Labour, Invalids and Social Affairs of Can Tho, requesting cooperation in investigating and clarifying the cause of the accident.
According to Mr. Yen, the inspection and review in accordance with the functions and duties of the Department of Labor Safety are prescribed in legal documents. When there is an accident related to the management field, the state management agency will cooperate with the investigation or conduct an independent investigation to make an assessment of the cause of the accident, thereby recommending to the parties related to remedy and prevent similar accidents.
Head of Legal Department – Inspector Nguyen Van Yen: The Department of Occupational Safety has proposed Can Tho Department of Labor, Invalids and Social Affairs set up an inspection team for elevator accident on July 16.
For the serious elevator accident in Can Tho (which happened on July 16), the inspector of the Can Tho Department of Labor, Invalids and Social Affairs will work with the hospital, comprehensively inspect the operation, maintenance and repair process elevator at the facility.
First, the inspector will clarify the contents related to the initial declaration of the elevator to use.
Secondly, whether the hospital performs periodic inspection or not, has adequate records or not, the maintenance of the elevator is guaranteed in accordance with the process and time.
Thirdly, to clarify, when accidents and serious incidents occur, has the hospital promptly reported to the state management agency according to regulations? If not reported, they must make a record of violations and handle them according to Decree 12/2022/ND-CP (sanctions for administrative violations in the field of labor). The representative of the Department of Labor Safety also proposed the Can Tho Department of Labor, Invalids and Social Affairs to issue a decision to establish an investigation team to conduct an investigation into this accident as “accidents without labor relations” in accordance with their investigative powers of state management agencies are specified in Decree 39/2016/ND-CP (detailing a number of articles of the Law on Occupational Safety and Health) and in other legal documents. Mr. Yen emphasized, after having full information about the accident, the Department should urgently make a report to the Department of Occupational Safety.
According to the latest information obtained by Elevator Magazine, the inspector of the Can Tho Department of Labor, Invalids and Social Affairs is carrying out the work in accordance with its authority. However, Can Tho Children’s Hospital said that the hospital’s elevator records manager was away, so he could not work to provide related records. It is expected that on Monday (July 25) to the hospital, there will be an official meeting with the Department’s inspector.
