Elevator Magazine since its inception has always had in-depth, useful and valuable articles for readers in the field of elevators. And immediately there was a fake “brother”: baothangmay.com (Elevator Newspaper).
Elevator Magazine is the mouthpiece of the Vietnam Elevator Association, licensed to operate under License No. 510/GP-BTTTT dated August 6th, 2021 of the Ministry of Information and Communications. Since then, Elevator Magazine has always operated in accordance with its principles and purposes and in compliance with the provisions of the Press Law.
In fact, in the past 6 months, many websites have blatantly posted content and images that infringe copyright of Elevator Magazine, typically website baothangmay.com (Elevator Newspaper). Despite the press name, there is no information on the operating license on the website. This website domain name is being registered by iNET Software Co., Ltd., has business registration license number 0103581701, issued on 11/03/2009, headquartered at 247 Cau Giay, Hanoi.
The act of violating the information copyright of the website baothangmay.com is rampant, copying a large amount of content posted on the electronic magazine tapchithangmay.vn. The blatant trick of this website is to copy, edit and publish articles and images that are copyrighted by Elevator Magazine but absolutely not cite sources. The plagiarisation of content based on changing, editing words, sentence structure, etc. is extremely noticeable on a large number of articles.
Some screenshots of baothangmay.com’s posts plagiarise from the content of Elevator Magazine:
The timelines show that Elevator Newspaper was published after Elevator Magazine and the content was only edited in terms of words, sentence structure, etc.
Similar to the above examples, this website also copies many articles from Elevator Magazine such as: Development direction of Vietnam’s elevator manufacturing auxiliary industry (Original post: Any solution for the manufacturing supporting industry). Vietnam’s elevator manufacturer?), The old town moves and the suitable home elevator solution (Original post: “The poor street” changes its body but does not change its clothes), the bridge elevator helps develop Vietnam’s tourism industry (Original article: Elevator – Expectation to become a bridge to develop tourism),…
In good faith, Elevator Magazine contacted via contact information provided on website baothangmay.com (Phone number: 0922.222.222; Email: baothangmay@gmail.com) but did not receive a reply.
According to Clause 1, Article 14 of the 2005 Intellectual Property Law (amended and supplemented in 2009 and 2019), it is clear that a journalistic work is a type of work protected by copyright. Clause 6, Article 28 – The Intellectual Property Law also stipulates that copying a work without permission of the author or copyright holder (except in some cases as provided for by other regulations), creating derivative works be classified as copyright infringement.
Therefore, the behavior of the website baothangmay.com can be claimed to be a serious violation of the Intellectual Property Law.
According to Article 11 of Decree 131/2013/ND-CP dated October 16th, 2013 (amended and supplemented by Decree 28/2017/ND-CP dated March 20th, 2017) regulating acts of infringing upon the right to publish works mentioned:
Article 12 also of the above Decree states:
Towards solving this problem, the Vietnam Elevator Association – the governing body of Elevator Magazine has sent an official dispatch to the Hanoi City Police, the Press Department, the Department of Radio, Television and Information, The Department of Cybersecurity and High-Tech Crime Prevention and Control to handle the case
Official letter of Vietnam Elevator Association sent to the authorities requesting support and handling in accordance with the law
Truth – fake is a dilemma that is pervasive throughout the market, not only in the field of information and press, but also in manufacturing and service industries such as elevators. Excluding fake, plagiarized and derivative products is to contribute to protecting the interests of customers and businesses.
Elevator Magazine will continue to inform readers about this issue.
